In an internal “Policy Directive,” Federal Immigration officers are “asserting” that agents do not need a warrant to “forcibly” enter a private residence to arrest a suspected “illegal alien” (a refugee fleeing conditions few American citizens could imagine, let alone tolerate) without “judicial” authority.
The memo, signed by the acting director of ICE, Todd Lyons, and dated May 12, 2025, says: "Although the U.S. Department of Homeland Security (DHS) has not historically relied on administrative warrants alone to arrest aliens subject to final orders of removal in their place of residence, the DHS Office of the General Counsel has recently determined that the U.S. Constitution, the Immigration and Nationality Act, and the immigration regulations do not prohibit relying on administrative warrants for this purpose."
It continues, "Should the alien refuse admittance, ICE officers and agents should use only a necessary and reasonable amount of force to enter the alien's residence, following proper notification of the officer or agent's authority and intent to enter."
Homeland Security spokeswoman Tricia McLaughlin claims that “…an administrative warrant has already had ‘full due process and a final order of removal.” She also said, “The Supreme Court and Congress have ‘recognized the propriety of administrative warrants in cases of immigration enforcement,’ without elaborating.”
That does not seem to apply to the tens of thousands of people who are being racially profiled for the color of their skin or speaking with an accent, assaulted, and kidnapped in school parking lots, or the corner grocery, or their churches, homes, or businesses without warrants or “full due process and a final order of removal.” ICE is sending out sadistic gangs of thugs to grab anyone who happens to be in the wrong place at the wrong time…to meet their quotas.
Supreme Court rulings prohibit law enforcement from entering a home without judicial approval, upholding 4thAmendment Rights that protect citizens from unreasonable searches, seizures, or arrests without ‘Probable Cause’ (strong evidence) and a warrant signed by a judge authorizing a search of specific places for specific items or people.
By their actions, the American Gestapo has publicly declared that it has every right to ignore those decisions when they deploy swarms of heavily armed, unidentifiable ICE agents to break down the front door of a suspect’s residence, terrorize the family, and ransack the home, whether they make an arrest or not.
In this campaign of racial cleansing, cruelty is the objective. While most of those being accosted have no criminal background and no charges against them, they’re being treated like rabid vagrant animals who must be violently subdued and removed from the population.
We’re seeing flurries of cases where very young children are being separated from their families and detained in DHS custody without representation for weeks and months longer than the twenty-day maximum allowed under the 1997 Flores Settlement Agreement, and many have been left to wander the streets searching for their missing parents. Peaceful protestors are being brutally attacked, pepper-sprayed in the face at close range, shot in the eyes with “non-lethal” ammunition, which has resulted in multiple victims being permanently blinded, or publicly executed by government assassins.
We should not be surprised that another American citizen was murdered on the streets of Minneapolis by the overpaid, under-trained, white-supremacist Federally sponsored domestic terrorists ravaging a peaceful city without constraints or consequence. Alex Jeffrey Pretti was shot at least four times after an officer removed a gun from his clothing that he had never touched during his arrest while trying to protect a woman who had been brutally knocked to the ground by those same agents.
Obviously, the Homan / Noem Secret Police Force has no intention of being inhibited by established law in their quest to abuse and expel anyone with brown skin who might speak another language or those unwilling to bow to Trump’s imperial reign.
On January 13th, the DHS Secretary announced a Homeland Security “termination of Somalia’s designation for Temporary Protected Status (TPS).” This means that every Somali refugee who is not a naturalized citizen must “self-deport” within 60 days or face ICE / Border Patrol arrest, incarceration, and forcible removal.
Most of Minnesota’s Somali population, estimated at more than 100,000, are U.S. citizens, but they are the prime target for Trump’s vengeance to normalize the military occupation of American cities without an official request by or consent of the elected leaders.
A significant Somali population (3000-6000) has integrated into Maine’s population around Lewiston and Portland since the first waves of refugees fleeing violence and conflict in their homeland began arriving in the early 2000’s. That quarry is the focus of the next phase of Trump’s institutional insurrection, with ICE goons flooding into the state to intimidate and attack their next victims.
The President has been threatening, and the Defense Department has ordered active-duty troops to prepare for deployment to Minnesota, but the 1878 Posse Comitatus Act states that the military cannot be used to enforce laws inside the United States unless Congress or the Constitution explicitly permits an exception. It does not allow the military to arrest or detain people, search or question people, take property, patrol protests or block off public areas, or help with immigration enforcement.
The primary exception to those provisions is The Insurrection Act, which empowers the President to deploy the military “to quell an insurrection against a state, address unlawful obstructions, combinations, assemblages, or rebellion” which inhibits the enforcement of law, “or an insurrection, domestic violence…or conspiracy” which results in the deprivation of constitutionally guaranteed rights, where the state is incapable of protecting those rights.
The Minneapolis Police Department is outmanned five-to-one by the Federal terrorists who have invaded the city and sewn violence and disruption in their vicious quest to hunt down every “immigrant” they can find. (Let’s agree that the government’s use of “illegal” is just a shameless sham). The only insurrection in this country is being waged by DHS and ICE against our fellow citizens.
The administration’s attack on diversity, equity, and inclusion and the domestic military invasions are the ultimate result of Trump’s decades long obsession with white supremacy, starting with 1970’s federal lawsuits against the family business (whose executives were exclusively white) for racial discrimination in turning away potential black tenants at their housing developments, or Trump’s full page ads in New York Newspapers demanding the execution of the “Central Park Five” - five black teenagers who were accused and convicted of raping a woman in the park, only to have those convictions vacated ten years later, when another man confessed to committing the crime.
He built his campaigns on tirades blaming specific groups of “others” (black, brown, Asian, Native American, those who worship in any religion besides “fake-Christianity” or, worst of all, Democrats or liberals) for the frustrations of his audience of bigots and racists. Hate’s an easy sell for a professional grifter, so he gave them excuses to fear their neighbors, permission to loathe anyone of a different heritage, and then provided convenient targets for their wrath.
He has weaponized and institutionalized that hatred by providing more than $175 billion for DHS to hire 10,000 new ICE agents, construct massive concentration camps to house at least one-hundred-thousand detainees, before they can be shipped out of the country on a new fleet of DHS/Border Patrol airliners. Border Czar Homan has boasted that the number of people being kidnapped off the streets by heartless, unqualified federal savages will skyrocket this year.
The violent and unconstitutional invasion we are witnessing in Minnesota is merely the first government-directed armed attack on the American people, our traditions, and our democratic system. The malicious curse will expand rapidly to conquer one democratic city after the next until armed troops control the primary functions of every municipality, forcing the population to accept federal domination, until the entire nation is held hostage by the whims and vengeance of a morally deficient fraud who places no value on human life.
If anyone had predicted the complete decimation of everything our nation has represented, since our founding two and a half centuries ago, within the first year after Trump’s inauguration, most people would have thought them mad. Unfortunately, our new reality is far more dangerous than any sane citizen might have feared. That cultural paranoia is the ultimate objective of this assault on our society…that we are being trained and manipulated to fear each other, and if you don’t fear your neighbor, you will fear the rampant fury of the government you elected.
There are several possibilities for our future…allowing this to continue until we all become prisoners in the American gulag dominated by Trump’s fascist billionaire buddies, or we fight back in a second civil war that would surely destroy the democracy we are trying to restore, or we can follow Minnesota’s example and shut this country down with peaceful demonstrations and labor strikes until Trump and every member of his administration is removed and every participant in this Federal attack on our culture and our society is incarcerated.
There is no tomorrow. We are living the nightmare, and we can see the endless path into darkness ahead unless the American people join together to demand an end to Trump’s madness before it's too late. We can’t wait for the next murder, or the next assault on another city, or the midterm elections, because, if Trump’s personal goon squad succeeds, the November elections will be hijacked or cancelled.
Our nation and our democracy will not survive unless we, all of us, take back the power granted by our founders, who started our Constitution with the phrase…We The People.
